POWER HVAC SERVICES INC. — SERVICE POLICY

Thank you for choosing Power HVAC Services Inc.™. Our Service Policy is designed to provide clear expectations regarding bookings, pricing, access, service performance, payment, cancellations and other conditions associated with our residential, commercial and industrial HVAC and cleaning services.

By booking, authorizing or proceeding with a service, the customer acknowledges the applicable quotation, booking information and service terms, subject to any rights provided by applicable law.

1. Service Bookings

Service appointments may be booked online, by telephone, text message, email or through an authorized representative of Power HVAC Services Inc.

A booking is considered scheduled once Power HVAC Services Inc. confirms the appointment.

Customers are responsible for reviewing their booking information and notifying us promptly of any errors concerning the service, property, appointment date, time, home size or other relevant information.

Appointment times are scheduled in good faith. Arrival times may occasionally be affected by traffic, weather, previous jobs, equipment requirements, site conditions or other circumstances outside our reasonable control.

2. No Upfront Payment

Where the customer selects Pay After Service — No Upfront Payment, no payment is required at the time of booking.

The applicable service amount becomes payable after completion of the authorized service unless different payment terms have been agreed to in writing.

Selecting this payment method does not make the service free and does not waive the customer's responsibility to pay the final amount properly due.

3. Pricing

Residential pricing may be based on factors including home size, number of HVAC systems, selected service and optional services.

Customers must select the home-size category that reasonably corresponds to the property being serviced.

If the property size, number of HVAC systems, equipment configuration, accessibility or scope is materially different from the information supplied when booking, we may explain any required price or scope adjustment before performing additional chargeable work.

Commercial and industrial prices may be based on quotations, site assessments, drawings, HVAC configuration, equipment, access requirements, working hours and project scope.

Unless expressly stated otherwise, prices are in Canadian dollars and applicable taxes are additional.

4. HST

Applicable HST is added to taxable services as required by law.

The website, booking page or quotation may display a service price before HST. The checkout, invoice or final billing documentation will show applicable taxes separately where appropriate.

5. Customer Authorization

Only work authorized by the customer or an authorized representative will be performed.

If technicians identify additional work that may be beneficial or necessary, the customer may be informed of the issue and any applicable additional charge.

Customers are not required to authorize optional additional work merely because it is identified during an appointment.

6. Property Access

The customer is responsible for providing reasonable and safe access to areas necessary to perform the booked service.

Depending on the service, this may include access to:

  • HVAC equipment and furnace areas
  • Supply and return vents
  • Mechanical rooms
  • Dryer vents and termination points
  • Rooftop equipment
  • Electrical or utility areas where relevant
  • Parking or equipment-access locations
  • Other areas included within the agreed scope

Furniture, personal belongings and other obstructions should be moved where reasonably necessary to provide safe access.

Our technicians are not required to move items that are excessively heavy, unsafe, fragile or outside the reasonable scope of the service.

7. Site Conditions and Safety

Power HVAC Services Inc. reserves the right to postpone, modify or discontinue work where conditions present a reasonable safety concern or prevent the service from being performed properly.

Examples may include unsafe electrical conditions, inaccessible equipment, hazardous materials, structural hazards, pest activity, unsafe ladders or roof access, aggressive animals or other hazardous conditions.

If a material condition affects the agreed scope or price, the customer will be informed before additional chargeable work proceeds.

8. Air Duct Cleaning Scope

Unless otherwise stated in the booking or quotation, the cleaning scope is limited to the components and areas reasonably accessible using the equipment and methods appropriate to the service purchased.

Cleaning does not constitute restoration or replacement of damaged, deteriorated, inaccessible or improperly installed HVAC components.

Where practical, Power HVAC Services Inc. may provide before-and-after photographs or other documentation of accessible areas.

9. Results and Existing Conditions

HVAC and duct systems vary considerably by property.

Results may be affected by system design, age, condition, accessibility, previous maintenance, construction debris, contamination, damaged ductwork and other existing conditions.

Air duct cleaning is intended to remove accessible accumulated dust and debris within the agreed cleaning scope. It is not a guarantee that all household dust, allergens, odours, mould, indoor-air-quality concerns or HVAC performance issues will be eliminated.

This distinction is important because some conditions originate outside the duct system or require separate diagnosis, remediation or repair.

10. HVAC Diagnosis and Repairs

Cleaning services should not be interpreted as a complete HVAC mechanical inspection unless diagnostic or maintenance services are specifically included.

Problems involving airflow, heating, cooling, electrical components, refrigerant systems, controls, motors or other mechanical components may require separate HVAC diagnosis or repair.

Any additional work and applicable charges will be discussed with the customer before authorization.

11. Existing Damage

Customers should inform us of known damaged, fragile or defective HVAC components before work begins.

Power HVAC Services Inc. is not responsible for deterioration, defects or failures that existed before service or that become apparent during normal access or cleaning, except to the extent responsibility is imposed by applicable law.

If our technicians discover significant pre-existing damage, we may document it and inform the customer.

12. Before-and-After Documentation

Where practical and accessible, photographs or videos may be taken to document:

  • existing conditions;
  • areas included in the cleaning scope;
  • before-and-after conditions; and
  • completion of commercial or industrial work.

Such documentation may also form part of the customer's service record.

Power HVAC Services Inc. will respect customer privacy and will not intentionally photograph private areas unrelated to the service.

13. Residential Appointments

Residential service durations shown or discussed are estimates.

Actual duration can vary depending on property size, number of HVAC systems, accessibility, duct configuration, condition and selected services.

Customers should allow reasonable access time beyond any estimated duration.

14. Commercial and Industrial Projects

Commercial, institutional and industrial projects may require an on-site assessment before the final scope and price are established.

A quotation may consider:

  • building size;
  • HVAC drawings;
  • number and type of HVAC units;
  • duct configuration;
  • rooftop units and AHUs;
  • ceiling heights;
  • access points;
  • lifts or specialized equipment;
  • operating restrictions;
  • after-hours requirements;
  • safety requirements; and
  • project documentation.

Where a written quotation or contract has been issued for a commercial or industrial project, that document takes precedence over this general Service Policy regarding any project-specific term that conflicts with this policy.

15. Cancellations and Rescheduling

We understand that schedules change.

Customers should provide as much notice as reasonably possible when cancelling or rescheduling an appointment.

Repeated last-minute cancellations, failure to provide access or missed appointments may affect our ability to accept or prioritize future bookings.

Any cancellation fee will apply only where it was clearly disclosed and agreed to before the booking or service, and nothing in this policy limits cancellation or other consumer rights provided by applicable law.

16. Missed Appointments and Access Problems

Customers should ensure that an adult or authorized representative is available when required and that technicians can access the property at the scheduled time.

If our technicians cannot obtain reasonable access, the appointment may need to be rescheduled.

For commercial properties, customers are responsible for coordinating required building access, security permissions, loading areas, elevators and other site requirements unless otherwise agreed.

17. Payment

Payment methods may include, where offered:

  • e-transfer;
  • credit card;
  • debit card;
  • American Express;
  • cheque; or
  • another approved payment method.

The final invoice will reflect the services actually authorized and completed, applicable taxes and any properly authorized additional work.

18. Final Invoice

A final invoice is provided following service completion in accordance with the applicable payment arrangement.

Customers should review the invoice and contact Power HVAC Services Inc. promptly if they believe there is an error.

A question regarding one portion of an invoice does not automatically invalidate amounts that are otherwise undisputed and properly due, subject to applicable law.

19. Service Concerns

If a customer has a concern regarding completed work, we ask that Power HVAC Services Inc. be contacted promptly with:

  • the customer's name;
  • order or invoice number;
  • service address;
  • description of the concern; and
  • photographs or other relevant information where available.

We will review legitimate service concerns and determine an appropriate response based on the service performed, agreed scope, available documentation and applicable law.

20. Re-Service Requests

Where we determine that an issue falls within the original authorized scope and reasonably requires corrective attention, we may arrange an inspection or re-service as appropriate.

A re-service request does not automatically include new work, additional systems, inaccessible areas, repairs, services not included in the original scope or conditions arising after completion.

21. Customer-Supplied Information

Quotations and bookings may rely on information supplied by the customer, including property size, HVAC configuration, photographs, equipment information and requested scope.

Customers are responsible for providing reasonably accurate information.

Materially inaccurate or incomplete information may require a revised scope, revised quotation or rescheduled appointment.

22. Third-Party Property

When a customer books service for property owned or controlled by another person, including a tenant, landlord, property manager or contractor situation, the person making the booking represents that they have appropriate authority to arrange access and authorize the requested service.

Responsibility for obtaining required owner, landlord, condominium or property-management permissions rests with the customer unless otherwise agreed in writing.

23. Pets, Children and Work Areas

For everyone's safety, customers should keep children and pets away from active work areas, hoses, tools, equipment and open HVAC components.

Technicians may temporarily restrict access to areas where equipment is operating.

24. Specialized Equipment

Certain commercial, industrial or difficult-access projects may require lifts, specialized vacuum equipment, robotic inspection equipment or other equipment.

Unless specifically included in the quotation, extraordinary equipment or third-party rental costs required because of site conditions may require customer approval and additional charges before being incurred.

25. Changes to Scope

The agreed scope may be modified only with customer authorization.

Where unexpected site conditions materially affect the feasibility, safety, duration or cost of the work, Power HVAC Services Inc. may pause the affected portion of the service and discuss available options with the customer.

26. Estimates and Quotations

An estimate is an anticipated price based on the information available at the time it is prepared.

A quotation may contain a more defined scope and price.

Commercial tenders, purchase orders, contracts and project-specific quotations may contain additional terms.

Where project-specific written terms conflict with this general policy, the project-specific written agreement governs to the extent permitted by law.

27. No Misleading Service Claims

Power HVAC Services Inc. aims to describe services accurately and transparently.

No employee, technician, website statement or marketing material should be interpreted as guaranteeing a result that cannot reasonably be guaranteed due to building conditions, HVAC design or factors outside the agreed service scope.

If there is a material discrepancy between an advertisement and a written quotation or booking, customers should request clarification before authorizing work.

28. Consumer Rights

Nothing in this Service Policy is intended to waive, restrict or override rights that cannot legally be waived under applicable federal, provincial or municipal law.

Ontario provides consumers with specific protections concerning certain contracts, cancellation rights and unfair or misleading business practices.

Where applicable law provides the customer with greater protection than a provision of this Service Policy, the applicable law governs.

29. Privacy

Customer information is used for legitimate business purposes associated with inquiries, quotations, scheduling, service delivery, invoicing, customer support and business records.

Personal information is handled in accordance with our applicable Privacy Policy and legal obligations.

30. Policy Updates

Power HVAC Services Inc. may update this Service Policy periodically to reflect changes in services, business practices or legal requirements.

The version applicable to a transaction will be subject to applicable law and any specific written terms provided to the customer.
